The real question is whether Mr. Obama will uphold the legal architecture necessary to continue the war against al Qaeda and its jihadist allies.And what might that legal system be? We have a criminal justice system which for the past 200 years has served our nation well. But in the mind of the right wing pundits today that stalwart system is not good enough.
The Bush administration in their quest to punish detainees created a new class of prisoners of war called "unlawful combatants." Today some in our nation wish to continue that failed course and to continue the unlawful detention of many who cannot be shown to be guilty of a single crime. While the Journal editor argues many have not been brought to trial even when evidence exists, the ones who have been brought to trial in nearly every instance have been found not guilty for lack of evidence at all.
If real evidence does exist why did not the Bush administration bring these people to trial? If that evidence is found to have been elicited by means of torture, then under our system of justice that cannot be admissable. We as a nation deserve the truth under all conditions. Continuing the current course of illegal detentions without trials has no place in our world if we hope to find humanity and morality in our future. The truth and only the truth will ever set us free.
